The thing with defects, is that they are on "suspicion" of being unroadworthy, not an official statement of fact.
Same as having mods done to your car and getting them engineered. A Police Officer can still defect you if they suspect they are unroadworthy. Theoretically a Police Officer can defect any car anywhere and there's nothing you can do about it-if he says it needs inspection it needs inspection.

I see in the papers that Scotts Transport in SA have been similarly busted with up to 12 trucks alledgedly found defective or tampered with.

Yes but they are not generally mechanics. Which means unless a drama is blatantly obvious, or their wife is menstruating, they don't touch. They like things like lights, wipers, oil leaks and of course weights and paperwork on the road, or a brake test if the rollers are out. Things where they don't have to get too dirty.

A defect is a defect in NSW. It has to be repaired with the defect given one of three inspection instructions, 1) self clearing requiring no action, 2) requiring an inspection at a Authorised Inspection Station or if you really piss them off 3) requiring an inspection at an RTA HVIS. Just about all defects are AIS. Self clearing defect notices are VERY rarely given and cover things like a cracked tail light lens or old wiper blade, or the Mermaid just wanting to feel important.

And a lot of those "defects" are really important safety issues like a tear in the seat upholstery, or the passenger's window winder being too stiff.

And when it comes to these companies who break these rules I really hope the "chain of responsibilities" can be followed through for too long the driver has been the scapegoat. I'm lucky I did all my stuff DRUG FREE & proud of it. I have had trucks coming at me head on & many other dramas. I've had many a forklift driver yell at me that I was due yesterday to me responding "I don't care mate I was tired I went to bed it's here today"
